The following General Terms and Conditions of Sale govern the sale of merchandise by Port2Port (PTY) Ltd. (" P2P " or "we") to you through www.port2port.co.za ("website"). Your use of the website to purchase merchandise indicates your agreement to follow and to be bound by these General Terms and Conditions of Sale.

All orders are subject to e-mail confirmation by us. Please note that the products displayed on the website may be out-of-stock or discontinued, and availability is not guaranteed.

2. Prices

All prices are in South African Rand (ZAR). Prices may change without notice from time to time. The total amount due is inclusive of sales tax applied in accordance with applicable state and local regulations based on your shipping address. The applicable sales tax amount is indicated on the payment page of the cart. The amount of sales tax charged on your order will depend upon various factors, including type of item purchased, sales price and destination of the shipment. Sales tax regulations may change between the time you place an order and the time of credit card charge authorization and this may affect the calculation of sales taxes. The amount appearing on your payment page of the cart may differ from the sales taxes ultimately charged as indicated in the invoice you will receive with the shipping confirmation e-mail.

3. Binding Agreement

Our order confirmation, these General Terms and Conditions of Sale and our other Site Policies shall be deemed the final and integrated agreement between you and us on the matters contained in these General Terms and Conditions of Sale.

Delivery Policy

Should we have your order in stock, delivery time will range between 3 - 5 working days.

Alternatively, should we have to order your stock from our suppliers, delivery time will range between 8 -12 working days.

You are responsible for the shipping costs associated with the delivery of the products you purchase on the website as specified on your order confirmation.

Returns

1. General Conditions

We want to make sure that you are completely satisfied with your purchases on this website. If, for any reason, you are not satisfied with your order, you may return any products within ten (10) days from the date of delivery. Before sending any products back to us, please make sure that all of the following conditions have been correctly satisfied.

The product you wish to return:

  • must be sent in its original packaging;

  • must be sealed effectively to allow for return shipping without compromising the content;

  • must be shipped back to our warehouse within ten (10) days of the date of delivery;

  • must be sent in one single shipment; products that belong to the same order must be returned to us at the same time; and

  • must be shipped from South Africa.

  • bottles of wine must contain at least half of their content and be sealed effectively utilizing the original cork.

  • does not fall in the VINTAGE or International Wines category. Vintage and International Wines are not returnable or refundable in any case.

Return will fall into one of two categories as outlined below:

a.) In case of products of which the quality has been compromised and if all of the above conditions are satisfied, we will refund the value of the returned product(s), Sales Tax included, less any original shipping costs.

b.) In case of dissatisfaction with the product of which the quality is uncompromised and if all of the above conditions are satisfied, Port2Port will offer a suitable replacement within the same price group.

We will not issue any refunds for returns that do not satisfy all of the conditions indicated above; provided, however, that you will have the option to request within thirty (30) days of being notified that you are not entitled to a refund that your merchandise be shipped back to you, at your own cost, in the condition in which it was received by the P2P’s warehouse. If you do not request the return of your merchandise within said thirty-day period, you authorize P2P, and any of its affiliates or agents, to dispose of such merchandise as it sees fit.

2. Refund Policy

Refunds are processed within approximately five (5) business days of our receipt of your merchandise. Your refund will be credited back to the same payment method used to make the original purchase on the website. If you paid by credit card, refund times will depend on the credit or debit card company’s policies. Be aware that the refund date for the credit will coincide with the date of the original payment, therefore you will not be charged any interest fees. If you paid by PayPal (where available), refunds will be credited to your PayPal account and will be visible immediately. The date of reimbursement to the credit card associated with your PayPal account depends on the company that issued the card. We offer no refunds on any products designated on this site as non-returnable.

Port2Port – pursuant to is the data controller of www.port2port.co.za users' Personal Data ("Personal Data"), which is collected for conducting, concluding and performing transactions for purchasing products on the aforementioned site ("Commercial Purposes"); P2P autonomously determines the purposes and means of processing Personal Data and the instruments used, including those for security measures. Due to organizational and operational purposes only, P2P has appointed certain entities that will also process Personal Data belonging to www.port2port.co.za’s users for purposes strictly connected to the performance of services on www.port2port.co.za, including the sale of products.   • Seabourne Express. We provide Seabourne Express, by electronic means, with customers' addresses and other personal data for the purpose of shipping, delivering and returning products purchased on the www.port2port.co.za website;
  • Drenalina spa and Hetzner PTY Ltd, for purposes related to the maintenance of P2P servers;
  • Pier2Pier. We provide Pier2Pier with personal data of users and customers for purposes related to direct marketing services of Port2Port and in connection with other services provided by Pier2Pier to Port2Port, such as call center and help desk services;
  • PayU. We provide PayU with personal data of users and customers for purposes related to the processing of payments.

When you execute purchasing procedures for products sold on www.port2port.co.za, we collect your Personal Data (such as personal details, e-mail address, address, and telephone number) on your order form only for the purpose of selling the products ordered by you.

Your Personal Data is mostly processed by electronic means and in some circumstances by paper-based means, such as when the processing of your Personal Data is required for preventing fraud on www.port2port.co.za. Your Personal Data shall be stored in a way which allows Port2Port to identify you for the period necessary for the purposes which the data was collected for and subsequently processed and, in any case, in accordance with applicable law. In all the above circumstances, your consent for data processing is not required. Your Personal Data will not be transferred abroad to non-SA countries that do not ensure an adequate level of protection of individuals.
